国家核证自愿减排量(CCER)交易机制的重启及其配套制度的加速完善,为储能项目实现其减排价值的经济转化提供了关键路径,也使其面临方法学适配、权属界定等独特的法律挑战。通过引入行政法中的双阶理论作为核心分析框架,将储能CCER的生成与流转过程明确划分为两个阶段:第一阶段是以行政确认与监管为核心的“公法生成阶段”,重点剖析项目方法学适配性、额外性论证以及登记行为的法律性质;第二阶段是以私权为核心的“私法流转阶段”,深入探讨CCER权利属性、作为质押担保权利瑕疵风险。最终,提出应构建分段而治、协同联动的法律规制路径,明确各阶段的法律原则,细化核证与交易规则,以期为我国储能产业的高质量发展和全国统一碳市场的法治化建设提供理论参考与决策支撑。
The relaunch of the China Certified Emission Reduction (CCER) trading mechanism and the accelerated improvement of its supporting systems provide a critical pathway for energy storage projects to realize the economic conversion of their emission reduction value. However
this also subjects them to unique legal challenges
such as methodology adaptation and the definition of rights. By introducing the two-stage theory from administrative law as the core analytical framework
the generation and circulation process of CCER for energy storage is clearly divided into two stages. The first stage
the "public law generation stage" centers on administrative confirmation and supervision
focusing on analyzing the adaptability of project methodologies
additionality demonstration
and the legal nature of the registration act. The second stage
the "private law circulation stage
" centers on private rights
delving into the attributes of CCER rights and the risks associated with defects in rights when used as pledge collateral. Finally
it is proposed that a segmented yet coordinated legal regulation path should be constructed
clarifying the legal principles for each stage and refining certification and trading rules. This aims to provide theoretical reference and decision-making support for the high-quality development of China's energy storage industry and the legal construction of the national unified carbon market.
